Welcome to Fraggle. This page (together with the documents referred to in it) tells you the terms (the "Terms") which apply when you use our fraggle.gi website or mobile applications and related services (each referred to as an "Application").
Please read these Terms carefully before using the Application. If you have any questions relating to these Terms please contact before you proceed. If you are a consumer, you have certain legal rights when you use our Application.
You can find more information about these rights at: https://www.oft.gov.gi/index.php/consumer-protection. Your legal rights are not affected by these Terms, which apply in addition to them and do not replace them. By setting up your Fraggle account, you confirm that you accept these Terms.

Fraggle is a local marketplace platform that connects private sellers and businesses ("Sellers") with buyers ("Buyers") in Gibraltar. Fraggle facilitates the listing, discovery and purchase of new and second-hand goods ("Items"). Fraggle acts as an intermediary between Buyers and Sellers and is not itself a party to any transaction between them, except where expressly stated.
Before you can buy or sell Items using our Application, you need to open a Fraggle account. When you open an account you may create a password or other secure login method. You must keep any password you create, or other secure login method, secret, and prevent others from accessing your email account or mobile phone. If another person uses these methods to access your account, you will be responsible for any activity carried out under it, and we are not responsible for any losses you suffer as a result, unless the person using your password obtained it because we did not keep it secure.
You may close your account by contacting us using the contact details above. We may suspend your access to your account, or close it permanently, if we believe that your account has been used by someone else, or if in our opinion you are abusing our Service (for example, by making repeated unreasonable complaints, misrepresenting Items, mistreating other users, or any other good reason).
Any individual or business may apply to list Items for sale on Fraggle, subject to our approval process. By listing an Item, you confirm that you are the lawful owner of the Item or have the right to sell it, that the Item is accurately described, and that it complies with all applicable laws and regulations.
Fraggle reserves the right to refuse, remove or suspend any listing at its sole discretion. Sellers are responsible for ensuring their listings are accurate, not misleading, and comply with our content standards set out in clause 9 below.
Private sellers are not charged commission on sales. Business sellers may be subject to a commission fee as set out in our fee schedule available in the Application. Sellers may also subscribe to a paid tier (Plus or Pro) to access additional features.
When you place an order through our Application, a contract for the sale of the Item is formed between you and the Seller. Fraggle facilitates this transaction but is not a party to it. You are responsible for reading the full item description before purchasing. All sales are subject to the Seller's listing terms.
A service fee may be applied to purchases made via card payment. This will be clearly displayed at checkout before you confirm your order.
Payment for Items is processed securely through Stripe. Buyers pay via card at checkout. Sellers receive payouts directly to their connected bank account via Stripe Connect. Payouts are subject to Stripe's terms and conditions and may take up to 3 business days to appear in your account.
Fraggle does not hold or process funds on behalf of Sellers beyond what is required to facilitate the transaction.
Items may be fulfilled via collection in person or delivery, as agreed between Buyer and Seller. Fraggle is not responsible for the physical handover of Items and does not guarantee delivery timescales where fulfilment is arranged directly between Buyer and Seller.
Where a collection PIN is provided, Sellers must verify the PIN before releasing an Item. Fraggle is not liable for Items released without PIN verification.
You have legal rights as a consumer in relation to Items that are not as described or are faulty. If you believe an Item you have received does not match its description, please contact the Seller in the first instance. If the matter cannot be resolved, please contact us at and we will do our best to assist.
Fraggle may, at its discretion, assist in mediating disputes between Buyers and Sellers but is not obligated to do so and cannot guarantee a particular outcome.
These content standards apply to any material you contribute to our Service, including listings, messages and profile information. Contributions must be accurate, genuinely held and comply with applicable law. Contributions must not:
The following Items may not be listed on Fraggle: illegal goods or substances, counterfeit or stolen goods, weapons or dangerous items, adult content, live animals, or any Item prohibited by Gibraltar law. Fraggle reserves the right to remove any listing and suspend any account found to be in breach of this clause.
Once a transaction is confirmed, cancellations are subject to agreement between Buyer and Seller. Fraggle does not guarantee refunds but may assist in facilitating a resolution. Where a refund is agreed, it will be processed via the original payment method where possible.
Sellers set their own prices. Fraggle does not control or guarantee the accuracy of any pricing displayed on the platform. Sellers may accept offers or bids at their discretion. Fraggle is not responsible for any pricing errors made by Sellers.
Fraggle may from time to time issue promotional credits or voucher codes. These are redeemable against eligible purchases on the platform. Credits have no cash value, are non-transferable, and must be used within the period stated. Only one voucher or credit may be applied per transaction.
We are responsible to you for any loss or damage that you suffer that is a foreseeable result of our breaching these Terms or of failing to use reasonable care and skill in relation to your use of our Service. We are not responsible for any loss or damage that is not foreseeable, or for any loss arising from transactions between Buyers and Sellers.
We do not exclude or limit our responsibility to you where it would be unlawful to do so, including for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
We process your personal data in accordance with our Privacy Policy which can be found in the Application and on our website.
If either we or you have any right to enforce these Terms against the other, that right will not be lost even if the person who has the right delays enforcing it. If a court or other authority decides that any part of these Terms is illegal or ineffective, the rest of the Terms will be unaffected and will remain in force.
We may change these Terms from time to time. If we make any changes which affect your rights in relation to our Service, we will notify you. These Terms are governed by the laws of Gibraltar and you can bring legal proceedings in relation to our Service in the courts of Gibraltar.

You may not use our Site or our Service in any way that breaches any applicable local, national or international law or regulation, or to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards in clause 5 below. You also agree not to access, interfere with, damage or disrupt any part of our Site or our Service or any network or equipment used in the provision of our Service without our prior consent.
We may from time to time provide certain features which allow you to interact through our Site or our Service, such as messaging between Buyers and Sellers. We may remove content in contravention of these Terms of Use as set out in section 6.
These content standards apply to any and all material which you contribute to our Service, and to any interactive services associated with it. Contributions must be accurate (where they state facts), be genuinely held (where they state opinions) and comply with applicable law in Gibraltar and in any country from which they are posted. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. Materials posted on our Service are not intended to amount to advice on which reliance should be placed. We disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our Site or Service.

The courts of Gibraltar will have jurisdiction over any claim arising from, or related to, a visit to our Site or use of our Services.
